Filing a DMCA Takedown Notice

Our Response to DMCA Notices
Upon receipt of a valid DMCA notice, we will:
- Review the notice to ensure it meets all legal requirements
- Remove or disable access to the allegedly infringing material promptly if the notice is valid
- Notify the user who posted the material (if applicable) that we have removed or disabled access to it
- Provide the user with a copy of the takedown notice
We typically respond to valid DMCA notices within 48 to 72 hours of receipt.
Incomplete or Invalid Notices
If your DMCA notice is incomplete or does not meet the legal requirements, we may:
- Request additional information to complete the notice
- Decline to process the notice until it is properly completed
- Evaluate the claim under our own policies even if it does not meet DMCA requirements
Counter-Notification Procedure
If you believe that content you posted was removed in error or that you have the right to use the material, you may file a DMCA counter-notification.
Filing a Counter-Notification
A valid counter-notification must include:
- Your Contact Information: Your full legal name, mailing address, telephone number, and email address
- Identification of Material: Identification of the material that was removed and its location before removal
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction in any judicial district where My Fan Theories may be found)
- Acceptance of Service: A statement that you will accept service of process from the person who provided the original DMCA notice or their agent
- Signature: Your physical or electronic signature

What Happens After a Counter-Notification
If we receive a valid counter-notification:
- We will forward it to the party who submitted the original takedown notice
- We will inform them that we may restore the removed content in 10 to 14 business days
- If the original complainant does not file a court action seeking an injunction against the alleged infringement, we may restore the content
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, My Fan Theories has adopted a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website by any users who infringe any intellectual property rights of others.
False Claims
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing or was removed or disabled by mistake may be subject to liability. We reserve the right to seek damages from any party who submits a false or fraudulent DMCA notice or counter-notification.
International Copyright
My Fan Theories is based in the United States and operates under U.S. copyright law. However, we respect international copyright laws and treaties.
